11. Warranty and technical assistance
Digicon is responsible for the design, good quality of labor and materials used in the
fabrication of its products, ensuring that the equipment and all its parts are free from
defects in material and fabrication. Digicon undertakes to replace or repair, in its sole
discretion, at its Gravataí - RS plant or its branch in Barueri - SP, any part or equipment that
presents a fabrication defect, without burden to the buyer, under the conditions set forth
below:
1. The buyer must bear the cost of transporting the product back and forth to the Gravataí-RS
plant or to the branch office in Barueri - SP.
2. The warranty period will be start from the issuance of the sales invoice and will
comprise:
a) 12 (twelve) months for equipment, accessories, parts and pieces, including the
legal warranty period of 90 (ninety) days.
Legal Guarantee:
The consumer has a period of 90 (ninety) days, starting from the date of issuance of the
sales invoice, to complain about apparent irregularities (vices), of easy and immediate
observation on the product, as the items that constitute the external part and any other
accessible to the user, as well as, appearance parts and accessories in general.
b) 90 (ninety) days for repairs and technical assistance.
3. The guarantee will be given to the buyer only upon presentation of the invoice (original
or copy).
4. The guarantee does not apply in the following cases and conditions:
a) defects and damage caused by accidents, negligence or reasons due to force
majeure;
b) defects and damage caused by improper storage or prolonged disuse;
c) defects and damage attributable to the misuse of the equipment;
d) defects and damage caused by improper operation or installation of the equipment.
e) resulting from vandalism.
f) natural nature (lightning strike, flood, etc.).
g) resulting from the foundation of the equipment in abnormal conditions of
temperature, voltage frequency or humidity outside the range specified in the
installation and operating manual of the equipment, provided they are proven.
h) reconditioning, chrome plating, nickel plating and painting.
5. The guarantee will be automatically canceled for equipment that:
a) undergoes modifications, adaptations or any changes made by the customer or by
third parties without the express consent of Digicon;
b) undergoes maintenance or repairs performed by personnel not authorized by
Digicon;
c) suffers alteration of its serial number or violation of the identification tag;
d) is not paid under the conditions, values and deadlines indicated in the invoice.
6. Digicon is not liable for any damages resulting from equipment shutdown.
7. Repair of the equipment under the warranty will be provided at Digicon’s premises.
