t ransportat ion cost s of w ind t urbines or defect ive it ems, of ret urning to ENAIR ENERGY
S.L. It does not cover, also.
ENAIR ENERGY S.L w e reserve the right t o supply a dif f erent model of w ind turbine or
component t o resolve claims accept ed under guarantee, as a replacement and if t he
original model is no longer manuf act ured. In this case, t he new model w ill be of equal or
higher perf ormance.
ENAIR ENERGY S.L it undert akes t o make use of t he obligat ions described in the
condit ions of t his Limit ed Warrant y, and in t he event of repair or replacement of def ault
at t ribut able t o the manufact urer, cover t he t ransport cost s of the subsequent ret urn to the
address regist ered cust omer and have t hem available w it hin a maximum period of 60 days
f rom t he date of receipt .
Si ENAIR ENERGY S.L w ere t o determine that t he problem of t he w ind t urbine is not due to
a def ect in mat erials and w orkmanship, then the Cust omer shall bear the cost s of t est ing
and processing generat ed.
Def ect ive complained Product s w hich do not meet t he specif icat ions w ill become t he
propert y of ENAIR ENERGY S.L., as soon as they have been replaced or paid.
Any ret urn of mat erial and replacement by ENAIR ENERGY SL under w arrant y condit ions,
const itute f ull set t lement and release of all subsequent claims of any person covered by
damages or ot her relief , and w ill be an impediment t o any I disput e subsequent ly presented
t o the person w ho accepts an agreement of this t ype.
LIMITATION OF LIABILITY
ENAIR ENERGY S.L it w ill not be liable t o the cust omer, direct ly or indirect ly, for any
f ailure or delay in t he implementat ion of it s w arranty obligat ions, w hich may be caused by
majeure f orce or any ot her unforeseen incident to the w ill of ENAIR ENERGY S.L.
ENAIR responsibilit y f or ENERGY S.L. arising f rom t his Guarantee Cert if icate is limit ed t o
t he obligat ions expressed above, expressly excluding any liabilit y f or consequent ial
damages such as loss of income or operat ing prof it s.
When the subject of t he claim is t he result of improper inst allat ion, ENAIR ENERGY S.L.
shall be liable only w hen explicit ly t hat inst allat ion w as part of t he scope of supply of t he
sales cont ract .
Any ot her securit y that is not expressly ment ioned in t his cert if icat e is excluded.
