Exclusions
In view of the above, there are certain things for which we exclude our liability and
certain things for which we do not, as explained below.
What we don’t exclude:
• We do not exclude or limit our liability for any of the following:
• death or personal injury caused by our negligence, fraud or fraudulent
misrepresentation;
• defective products under the Consumer Protection Act 1987; or
• any other matter for which it would be illegal or unlawful for us to limit, exclude or
attempt to exclude our liability.
What we do exclude:
Except as set out in the preceding paragraph, we exclude all liability for any
losses, whether in contract or tort, for any direct, indirect, incidental, special or
consequential damages (including any legal fees and expenses you incur and for any
lost data, opportunity, goodwill, revenue or profits) or any other damages arising out
of or in connection with:
• any information or data contained in the product;
• the use of the product; or
• any content or service accessed by you or any third party.
In view of the services which are outside our control as explained above, in particular
we exclude all liability for any losses that you may suffer arising from any of the
following:
• the availability (or unavailability), speed and quality of the Internet connection to
your product;
• the availability (or unavailability), suspension, removal or termination of any third
party content or service including of the language or the features supported by that
service; and
• any change to third party content or services (including any associated APIs) that
affects the functionality of the software installed in the product (e.g. Apps).
Your statutory rights aren’t affected
Nothing we have stated here affects or diminishes your rights as a consumer under
the law. For further information about your legal rights please contact your local
authority Trading Standards Department.
