Installation.
The
date
on
your
purchase
invoice
or
sales
receipt
is
the
Date
of
Installation
unless
IBM
informs
you
otherwise.
The
warranty
period,
type
of
warranty,
and
service
level
that
apply
to
your
Machine
are
designated
in
Part
3.
Limitation
of
Liability:
The
following
replaces
item
1
and
item
2
of
this

1.
damages
for
bodily
injury
(including
death)
or
physical
harm
to
real
property
and
tangible
personal
property
caused
by
IBM's
negligence;
and
2.
the
amount
of
any
other
actual
direct
damages,
up
to

greater
of
$100,000.00
or
the
charges
(if
recurring,
12
months'
charges

Machine
that

subject

claim.
