WARRANTY
FIVE (5) YEAR SPA SURFACE WARRANTY
The manufacturer, Lumi-O | Innovaplas inc., warrants the interior acrylic spa surface against blisters, cracks, or delaminating resulting from a defect in
the acrylic surface material for a period of five (5) years from the date of purchase, based on the pro-rata**. The costs of removing, reinstalling and any
shipping charges related to the structural repair of a spa are the responsibility of the spa owner.
** Pro-rata : Suggested retail price, divided by 60 months, multiplied by months of use, plus shipping and handling = replacement cost.
ONE (1) YEAR LIMITED SPA EQUIPMENT WARRANTY
The manufacturer warrants the electrical equipment (the pump, heater, spa pack, top-side control), and the plumbing to be free of defects in
materials and workmanship for a period of one (1) year parts and labor on these items. Warranty is limited to ninety (90) days on the following
optional accessory items only (waterfall assembly, rotating jets, GFCI). All perishable items (spa cover, filter cartridges, cover straps, vinyl cover, cover
lifters, waterfall housings, standard lightbulbs and LED lights, light lenses, fuses, headrests, cabinet, spa drain, jet inserts) are warranted to be free of
defects in materials and workmanship at the time of delivery.
WARRANTY PERFORMANCE
Labor charges related to repair or replacement of defective components, as listed in the Parts section of this warranty, will be free of charge for a period
of one (1) year provided that defective components are returned to Lumi-O | Innovaplas inc. or one of its authorized dealers for repair. The spa owner
may be subject to an authorized dealer trip charge which is not covered by this warranty. Any other terms and conditions related to labor warranty are
an agreement between the original purchaser and the authorized dealer. The original purchaser should consult their authorized dealer for individual
terms, conditions and procedures with respect to labor warranty. Lumi-O | Innovaplas inc. does not assume any liability or obligation with respect to
labor warranty should an authorized dealer cease to do business.
LIMITATIONS AND EXCLUSIONS
This limited warranty takes effect from the date the spa was originally purchased and extends to the original purchaser, only. This limited warranty does
not apply to a spa used for any commercial, rental or club purposes. The purchaser must establish the date of purchase by dated sales invoice or
delivery receipt. This limited warranty does not cover damage resulting from abuse, misuse, neglect including any installation, operation, maintenance
or use of the spa other than in accordance with the owner’s manual of this spa. Damaged caused by operation of the spa in water temperatures
outside of 45F (7C) and 104F (40C), damage caused by dirty, clogged or calcified filter cartridges, damage to the spa surface caused by improper use
of chemicals or cleaning agents, allowing undisolved spa sanitizing chemicals to lie on the surface, damage caused by improper pH balance or other
improper water chemistry, damage caused by failure to provide even and sufficient support for the spa, are considered abuses and may invalidate this
limited warranty. Damage caused by repairs or alterations performed by anyone other than an authorized service representative is not covered. Failure
caused by accidents, acts of God, nonstructural normal wear and tear, cosmetic blemishes and other causes beyond our control are excluded. The
warranty is in lieu of all other warranties, expressed or implied, including implied warranties of merchantability and fitness for a particular purpose. In no
event shall the manufacturer be liable for incidental or consequential damages. Without exception, any damage caused by removal of the spa will not
be covered by the warranty.
DISCLAIMERS
The spa owner is required to provide unencumbered access to the spa for any warranty repair or inspection. Manufacturer shall not be liable for loss of
use of spa or other incidental or consequential costs, expenses or damages, which may include, but are not limited to water damage, or the removal
of a permanent deck or other customer fixture. Under no circumstances shall we, or any of our representatives be held liable for injury to any person
or damage to any property, however arising. This warranty gives you specific legal rights and you may have other rights. No service company, or other
party is authorized to change, modify, or extend the terms of this limited warranty in any manner whatsoever. Some states/provinces do not allow the
exclusion or limitation of incidental or consequential damages. The above limitations and exclusions may not apply to you. The jurisdiction and venue
for any litigation arising with respect to the transaction evidenced by this warranty shall be the Court in and for Saint-Jérôme, Quebec, Canada and
buyer hereby agrees to such jurisdiction and venue.
During the winter months, it is the spa owner’s responsibility to ensure that the spa’s plumbing and shell do not freeze. This warranty does not cover
damages caused by frost.
